A jury has awarded a trucking firm $1.85 million after Chamblee Ryan attorneys proved that Trendsetter HR didn’t obtain the workers’ comp insurance it promised.

Online PR News – 03-March-2016 – A Texas jury has awarded Central Freight Lines, Inc. $1.85 million after Chamblee Ryan attorneys proved that a human resources outsourcing firm failed to obtain the workers’ compensation insurance it promised. Those lawyers should also periodically check on whether outsource HR companies are meeting the terms of their contracts.

Initially, Rockwall, Texas-based Trendsetter HR, L.L.C. (also known Trend Personnel Services Inc. and TSL Staff Leasing, Inc.) sued Central Freight, a regional trucking firm based in Waco, claiming it failed to pay $400,000 in insurance premiums.

“After we were called to defend Central Freight Lines from the initial lawsuit, we quickly determined that Trendsetter HR’s claims were untrue, and that the HR firm had failed to obtain workers’ compensation insurance for Central Freight Lines for nearly three years,” says Bill Chamblee, founder and managing partner at Dallas-based Chamblee, Ryan, Kershaw & Anderson, P.C. “The trucking company paid out roughly $1.5 million toward insurance premiums in that time yet went unprotected from workers’ comp claims, despite promises made.”

A jury deliberated for about seven hours before awarding $1,483,648 for breach of contract damages, plus about $351,000 in attorney fees, to Central Freight Lines on Dec. 11, 2015, in Judge David Rakow’s 439th District Court in Rockwall County. Mr. Chamblee defended and countersued on behalf of Central Freight Lines alongside fellow Chamblee Ryan attorney Weston L. Hall.

By some media accounts, nearly 85 percent of all U.S. firms have outsourced some aspect of their human resources services, says Mr. Chamblee.

“Companies must know whether their HR outsourcing firms will deliver on their promises — especially when it comes to obtaining workers’ compensation insurance,” Mr. Chamblee says. “All companies that choose to outsource their human resources services should employ lawyers to vet outsource HR firms to more effectively determine if they will keep their word.”

Mr. Chamblee adds that those lawyers should also periodically check on whether outsource HR companies are meeting the terms of their contracts.
